1. About FluxPulse Market

FluxPulse Market is a peer-to-peer online marketplace that connects independent buyers and sellers. We are not a party to any transaction. Every transaction — including pricing, item condition, delivery, and exchange — is solely between the buyer and seller.

We do not own, inspect, hold, guarantee, or take responsibility for any items listed, bought, or sold through the platform.

2. Platform Fees

FluxPulse Market charges a flat 8% commission on the final sale price of every completed transaction. There are no listing fees, subscription fees, or hidden charges.

The 8% commission is deducted automatically from the seller's sale amount at the time of payment processing. Sellers receive the remaining 92% via Stripe payout.

3. Seller Responsibilities

By listing an item on FluxPulse Market, you confirm that:

• You have the legal right to sell the item
• The item is not stolen, counterfeit, or otherwise illegal to sell under applicable law
• The item description accurately represents the item's condition, features, and any known defects
• You will fulfill the transaction as described — including shipping or arranging meetup delivery as indicated
• You accept FluxPulse Market's 8% commission on the final sale price

Sellers are solely responsible for the accuracy of their listings and the legal status of their items. FluxPulse Market is not liable for misrepresentations, failed deliveries, or illegal items listed by sellers.

4. Buyer Responsibilities

By purchasing through FluxPulse Market, you agree to:

• Complete payment at the listed price at the time of purchase
• Confirm meetup receipt and item condition in a timely manner when applicable
• Inspect the item upon receipt or meetup exchange — FluxPulse Market does not guarantee the condition, authenticity, or legal status of any item

Buyers bear full responsibility for verifying item condition and authenticity at the time of exchange.

5. Local Meetup Transactions

For sales completed via local meetup:

• Payment is held in escrow by Stripe until the meetup is confirmed
• Both parties must verify the meetup using the PIN-based verification system on the FluxPulse Market meetup page
• After both parties confirm, payment is released to the seller (minus the 8% FluxPulse Market commission)
• If meetup is not confirmed within the PIN expiration window, the payment may be refunded to the buyer

6. Prohibited Items and Conduct

The following are strictly prohibited on FluxPulse Market:

• Stolen, counterfeit, or pirated goods
• Illegal items or items that violate applicable law
• Goods that infringe on third-party intellectual property rights
• Fraudulent listings or misleading descriptions
• Attempting to conduct transactions outside the FluxPulse Market platform (to circumvent fees or avoid buyer protection)

Violations may result in account suspension, listing removal, and referral to law enforcement where appropriate.

7. Limitations of Liability

FluxPulse Market and its operators are not liable for:

• The condition, authenticity, legality, or safety of any item listed or sold
• Any dispute between a buyer and seller — we do not arbitrate transactions
• Harm, injury, or theft occurring during a local meetup
• Items not delivered, misrepresented, or otherwise failing to meet seller descriptions
• Any indirect, incidental, or consequential damages arising from use of the platform

Our total liability for any claim arising from use of FluxPulse Market is limited to the amount of fees paid by the user to FluxPulse Market in the 12 months preceding the claim (if any).

8. Account and Registration

Sellers create accounts using an email address and password. Sellers are responsible for keeping their login credentials secure. We are not liable for unauthorized access to seller accounts.

Buyers are not required to create an account — purchases are tied to the email address provided at checkout.

9. Payment Processing

All payments are processed by Stripe, a third-party payment processor. FluxPulse Market does not store your payment card information. Stripe's privacy policy and terms of service apply to payment processing.

Payments are subject to Stripe's fraud detection and risk controls. FluxPulse Market is not responsible for payments declined or held by Stripe for fraud review.

10. Intellectual Property

The FluxPulse Market name, logo, and design are property of FluxPulse Market. You may not use them without permission. User-generated content (listing descriptions, images) remains the property of the user who created it.

11. Indemnification

You agree to indemnify and hold harmless FluxPulse Market, its operators, and Polsia from any claims, damages, or expenses arising from your use of the platform, your listings, or your transactions with other users.

12. Governing Law

These Terms are governed by the laws of the State of Texas, United States of America, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Bexar County, Texas, or the appropriate federal court in the Western District of Texas.

13. Account Suspension and Termination

13.1 Right to Suspend or Terminate. FluxPulse Market reserves the sole and absolute right to suspend, restrict, or permanently terminate any seller or buyer account at any time, with or without prior written notice, if we determine in our sole discretion that the account has been used in connection with:

• Any activity that violates these Terms of Service or any applicable law, regulation, or ordinance;
• Fraudulent activity, including but not limited to misrepresentation of items, non-delivery of paid goods, chargebacks without valid cause, or false identity information;
• Activity that poses a risk to the safety of other users, including but not limited to local meetup-related incidents;
• Repeated failure to complete local transactions in good faith;
• Harassment, threats, or abusive behavior directed at other users, FluxPulse Market staff, or representatives;
• Use of the platform to facilitate illegal transactions of any kind; or
• Any other conduct that FluxPulse Market deems inconsistent with the safety, integrity, or mission of the platform.

13.2 No Prior Notice Required. You acknowledge and agree that FluxPulse Market is not required to provide advance written notice before suspending or terminating your account under Section 13.1. Notice may be provided after the fact at the platform's discretion.

13.3 No Guarantee of Reinstatement. If your account is suspended or terminated under Section 13.1, FluxPulse Market makes no guarantee that access will be restored. Reinstatement is at the sole discretion of FluxPulse Market and is not guaranteed under any circumstance.

13.4 Reinstatement Window. If you believe your account was suspended or terminated in error, you may submit a written appeal and supporting documentation to FluxPulse Market within forty-five (45) calendar days of the date of suspension or termination. After the 45-day window has passed, FluxPulse Market is under no obligation to review, reinstate, or respond to any appeal submitted late. Submission of an appeal does not guarantee reinstatement.

13.5 Account Data After Termination. Upon permanent account termination, FluxPulse Market may retain such data as required by law and may delete all other account data at its sole discretion.

13.6 No Liability. FluxPulse Market, its operators, affiliates, and representatives shall not be held liable for any damages, direct or indirect, arising from the suspension or termination of any account under these Terms.

14. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the platform after changes constitutes acceptance of the new terms.
